1. Acceptance of Terms

By accessing and using Chipling ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Description of Service

Chipling provides a visual discovery engine and curation platform. You understand and agree that the Service is provided "AS-IS" and that Chipling assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

3. User Conduct

You agree to not use the Service to:

  • Upload, post, email or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
  • Harm minors in any way.
  • Impersonate any person or entity.
  • Upload images that you do not have the right to transmit.

4. Intellectual Property

You acknowledge and agree that the Service and any necessary software used in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws.

Your Content: You retain all rights to any content you upload. By uploading content, you grant Chipling a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing the Service (e.g. for the "Ripple" recommendation engine).

5. Termination

You agree that Chipling may, under certain circumstances and without prior notice, immediately terminate your account and access to the Service. Cause for such termination shall include, but not be limited to, breaches or violations of the TOS or other incorporated agreements or guidelines.

6. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
